FREEDOM OF INFORMATION REQUESTS
F.O.I.L.
F.O.I.L.
It is the policy of the Sheriff's Office that access to records maintained by the Sheriff's Office shall be presumed authorized unless State or Federal Law specifically prohibits access to such records, or if they fall within one or more grounds for denial appearing in Pub. Off. L. '87 (2) (a) through (I).
FOIL requests should be made in writing by completing the FOIL Request Form; CCSO FOIL Request Form. Certain requests, such as the daily review of the police blotter by members of the press, can be made orally. All attempts will be made to assist persons requesting records orally. Prior to submitting a FOIL request, the requester may contact the records officer to discuss the request.
NOTE: FOIL Request Forms or any other request under the FOIL law will not be accepted by FAX or E-MAIL.
A FOIL Request Form can be obtained at the Sheriff's Office or by downloading; CCSO FOIL Request Form. The person making the FOIL request will need to provide as much of the following information as possible:
1. The name, address, telephone number and FAX number of the requester.
2. A description of the record being sought. Use of the record names from the subject matter list will expedite the process and eliminate the need for reply correspondence requesting clarification.
3. Dates and times relating to the record(s) when applicable.
4. Any other information that will help identify the record.
Completed FOIL Request Forms may be submitted by mail or delivered in person. The request is deemed to have been received when the Administrative staff processes it during normal business hours. Records are available for inspection and copying Monday through Friday, excluding legal holidays, from 9:00 a.m. until 4:00 p.m. by appointment only.
If a Freedom of Information Request is made in person, please understand that the report/information can not be done immediately while you wait. Every attempt will be made to fill the request within the time period allowed by law. At times, due to the size or complexity of the request, a records request may take longer then the prescribed time period. The requester will be notified when this occurs.
The Sheriff's Office will not charge a fee to search the records, the inspect of records, or any certification of records. Only the fee allowed by local or state law will be charged.
If a request is made for photo static copies or copies on other medium, the records officer will reply to the requester advising whether the records requested are available and detailing the cost of making the copies before they are produced. Upon receipt of the fee, the records will be reproduced and forwarded without delay.
For further information concerning FOIL request, call 518-828-0601 ext. 1415.
