                       NURSING HOME EMPLOYEE ARRESTED
                                                         October 9, 1008


Philmont, NY – Columbia County Sheriff David W. Harrison, Jr. reports that 25 year old Julian O. Smith of Carroll
Street Hudson, NY was arrested and charged with Endangering the Welfare of an Incompetent Person, a class A
Misdemeanor.  The investigation began in early September and resulted in Smith’s arrest October 6th @ 11:35am
when he voluntarily turned himself into the Sheriff’s Office Criminal Investigation Branch.

Smith was employed by the Pine Haven Nursing Home on route 217 in Philmont when he allegedly used excessive
force to place an elderly female resident in her bed causing bruising to her arms while also using profanity
towards the victim.

Pine Haven Officials had taken immediate action by terminating employment of Smith, notifying the family of the
incident and contacting the NYS Department of Health. Family members of the victim contacted the Sheriff’s
Office. Pine Haven employees cooperated with Sheriff’s Office Criminal Investigators.

Smith will answer the charge in the Village of Philmont Justice Court October 16th @ 5:30pm.

Sheriff Harrison commended the Pine Haven Home Administrators for their swift and decisive action when they
discovered that this had occurred thereby insuring the safety of the resident involved.  He said; “We must
continue to be assertive when it comes to protecting those who may not be able to protect themselves”.

At this time it appears that no other residents were endangered by Smith and that this was an isolated incident.
