FATAL ACCIDENT-ARREST OF BROTHER
October 25, 2007
Kinderhook, NY – Columbia County Sheriff David W. Harrison, Jr. reports that his office is investigating a one car
fatal automobile accident that occurred this morning in the Town of Kinderhook. At 7:07am, County 911 assigned
Sheriff’s Patrols to a reported unknown personal injury accident on state route 203 at the intersection with Novak
Road in Kinderhook. Deputy Sheriff’s, Valatie Firefighters and Valatie Rescue Squad members found that the
accident was serious with entrapment. The Valatie Fire Department extricated the victim, 24-year-old William E.
Everetts, Jr., who was transported to Columbia Memorial Hospital where he was pronounced dead.
The driver of the car, 20-year-old David P. Everetts, the deceased’s brother, was operating a 1994 Pontiac Grand
Prix westbound on route 203 when he lost control of the vehicle, sliding across the eastbound lane and struck
guardrails on the east side of 203 at the intersection with Novak Road. David Everetts who appeared to have
minor injuries, initially refused medical attention at the scene.
Assistant District Attorney David Constanza responded to the scene and assisted investigators in applying for a
Search Warrant which was issued by County Court Judge, the Hon. Paul Czajka, as part of the investigation.
David Everetts was arrested and charged with Driving Under the Influence of Drugs or Alcohol, Vehicular
Manslaughter 2nd degree a class D Felony, Driving While Intoxicated, 2 Counts of Reckless Endangerment 2nd
degree, Aggravated Unlicensed Operation 2nd degree, Speed Not Reasonable and Prudent and Failure to Keep
Right.
Arraigned by Stockport Town Judge, the Hon. James Funk, Everetts was remanded to the County Jail with No Bail
to return to Kinderhook court at a later date.
Deputy Sheriff Louis Bray and Investigator Paul Graziano are leading the investigation. Along with other
uniformed Deputy Sheriffs and Criminal Investigators, Sheriff Harrison, Undersheriff James Sweet, Captain David
Bartlett, Senior Investigators William Foster and Kevin Skype and Coroner Angelo Nero also responded to the
scene.
